JE:  This is one of the things that the licenses available from Creative
Commons address.  In effect, as someone affiliated with CC told me, CC makes
it possible to "brand" the public domain--that is, to tell what is and is
not protected by copyright.

I was surprised to learn that CC has not taken off as rapidly as one might
have expected.
