Inter-library loan - definitions
Here is the draft wording which a couple of the PA/JISC working party members came up with - please bear in mind that it is not (yet!) an official part of the 'model licence'. It is, of course, written from a purely UK standpoint as it stands (though it would not be difficult to broaden the references to applicable copyright legislation). We'd be most interested in any comments. Sally Morris Inter-library loan Paper-to-paper Inter-Library Loan (permitted under Sections 37-44 of the Copyright Designs and Patents Act, 1988, as amended by any subsequent Statutory Instruments) - the provision (whether by post, fax or secure intermediate electronic transmission), for purposes of reasearch or private study, to a user at another library, of a paper copy of a paper original of a specific document, Paper-to- paper Document Delivery - the provision (whether by post, fax or secure intermediate electronic transmission), to a user at another library or elsewhere, of a paper copy of a paper original of a specific document, where the provider, the recipient or both are not permitted to do so under Sections 37-44 of the Copyright Designs and Patents Act, 1988, as amended by any subsequent Statutory Instruments. Paper-to-electronic Document Delivery - the provision, by electronic means, to a user at another library or elsewhere, of a retained electronic copy of a paper original of a specific document. Electronic-to-paper Document Delivery - the provision (whether by post, fax or secure intermediate electronic transmission), to a user at another library or elsewhere, of a paper copy of an electronic original of a specific document. Electronic-to-electronic Document Delivery -the provision, by electronic means, to a user at another library or elsewhere, of a retained electronic copy of an electronic original of a specific document. (Comments) Paper-to-paper ILL would be a Permitted Use in all licences (for clarity, I've only used the term ILL for that which the Copyright Act currently explicitly permits). All other kinds of DocDel would be optional (square brackets in licence terms). Internal redistribution to other authorised users within the licensed site should be covered separately.
