Most publishers require authors to sign a written contract specifying, among other things, that a submitted article has not been published elsewhere. Such agreements make the author liable for damages caused by misrepresentations. This is one of the many complex legal issues involved in publishing that contribute to the high legal expenses and high premiums for errors and omissions (professional liability) insurance publishers incur.
