I agree that being "free" does not change the analysis of the terms.

I also agree that the language appears too restrictive of rights of use
that we would normally call fair use, and I see a danger of agreement
being a vitiation of fair use rights.  This is a paragraph of a kind I
have successfully had changed in similar contracts.  --pg
