In Wake of Costco v. Omega: "Fair Degree of Confidence"?



Just wondering what you all think of this Library Journal news 
item about the implications of a court case involving copyright 
law and libraries' rights to lend books:

"Academic libraries don't handle uncertainty well, especially not 
when it comes to questions about their buying and lending 
practices. That's why the recent Supreme Court ruling in the case 
of Costco v. Omega was perhaps so frustrating: instead of setting 
national precedent one way or another regarding a library's right 
to purchase and lend foreign-made materials , i.e., books and 
audiovisual works, the court instead upheld only the Ninth 
Circuit's ruling with a 4-4 split decision."
