If the library truly "owns" the book, then the library should have the right to digitize it. The snag is in the word "owns" because most libraries don't own a book. They own a copy of it or, if a special collection item, the ownership is covered by a deed of gift that may leave copyright with the donor. I'm not sure that libraries truly "own" very many books.
