One might ask whether the members of the PubMed Central National Advisory Committee (http://www.pubmedcentral.nih.gov/about/nac.html) have an overly close relationship with members of the Board of Trustess of BMC (http://www.biomedcentral.com/info/about/trustees). One person serves on both bodies, and the PMC board has a member who has been a paid consultant for the organization of a member of the BMC board. I certainly don't know that the close relationship is the cause for the seemingly preferential treatment you describe, but it does raise the appearance of an inappropriate duality of interest that could be seen as driving PMC practice.
