It does appear as if restrictive database legislation is raising its head once again. Such legislation was unsuccessful in the 104th, 105th and 106th Congresses but the proponents took a break in the 107th. But the database industry (led by Reed Elsevier, Thompson, and the Software and Information Industry Association) continues to press for additional legislation. The library associations are right on the case, and they've already filed a letter in opposition to the anticipated measure (which has not yet been introduced).
