Conflicting statements about who may access journal in Project MUSE



Greetings,

The appended announcement "THEORY INTO PRACTICE DEBUTS IN PROJECT MUSE"
led me to discover a discrepancy between two documents regarding who can
be granted access at a subscribing institution:

1.) TERMS AND CONDITIONS OF PROJECT MUSE SUBSCRIPTIONS

(http://muse.jhu.edu/proj_descrip/terms.html) states: "A subscription to a
Project MUSE package plan grants unlimited access to the full text of the
journal titles in that package for educational, research, and personal use
by the faculty, staff, students, alumni, library patrons and other
authorized users of the subscriber's geographically-contiguous
campus/institutional network. Distance learners, alumni, and other
off-campus affiliates may access Project MUSE if their Internet access is
through the campus network or via a secure proxy server."

2.) The "Publisher's Statement" for the journal in that announcement
(http://muse.jhu.edu/journals/theory_into_practice/information/publishers_st
atement.html), however, states: "Subscribing institutions are expected to
make their best feasible efforts to enable access only to faculty,
students, and staff--those people who are registered users of the campus
network" ... which is clearly more restrictive.  (Or is it?  What if
alumni ARE or can be "registered users of the campus network"?  Can the
"--" be interpreted as a Boolean OR?)

Which statement prevails when one is more restrictive than another for the
same online resource? I don't see how a subscribing institution could
enforce a more restrictive access for some journals in Project MUSE than
others, which would mean that the most restrictive one (if that were to
override the other) would in effect determine the access level for all
others, which doesn't seem quite acceptable.
