Has anyone come to an agreement with Nature specialist journals? The language of the indemnity clause indicates that libraries that sign the license can be held responsible for reckless behavior by faculty or staff that is really beyond our control, and that there is no way we can ever police this. See below. BTW, "You" is the institution. "You shall be responsible for any claims or legal proceedings arising from any misuse of the Service under this Agreement, whether authorised by you or not, (including, but not limited to claims in respect of breach of copyright or other infringements of our Intellectual Property Rights) which are brought against you by third parties." 12.2 "This paragraph shall survive the Renewal Date without prejudice to other remedies."
