I tend to take the position that if contract language is more 
restictive than fair use provisions, the language should be 
changed whenever possible.

One can't assume that publishers must be well aware of
fair use, and therefore the more restrictive language somehow
doesn't count. Publishers may well be aware of fair use, and
may have specific reasons for incorporating limitations.
