NCCUSL limiting UCITA self-help

Subscribers may be interested in this latest news about UCITA's self-help
provisions, from "Bytes in Brief" Sep. 2000:

"UCITA GROUP PULLS PLUG ON PULLING THE PLUG

"One of the most controversial aspects of the Uniform Computer Information
Transaction Act has been the so-called "self-help provision" that allows
vendors to remotely disable the software they sell if contractual
conditions are violated. On August 9th, the National Conference of
Commissioners on Uniform State Laws (NCCUSL) agreed to end the self-help
provision for mass market software sold at retail. However, the provision
will remain in effect for other software, including customizable
applications purchased by companies. Thus far, Maryland and Virginia are
the only two states that have adopted UCITA, and Virginia's UCITA does not
become effective until next year. The revision is not currently available,
but should be posted soon at
